The petitioner seeks regular bail in connection with Bhabua P.S. Case No. 340 of 2019 for the offence registered under Sections 147, 148, 149 and 302 of the Indian Penal Code. The allegation is regarding the co-accused person, namely, Tejbali Singh having taken the nephew of the informant to the Deotra Baba Asthan where the accused persons including the petitioner herein are stated to have assaulted him by means of knife and dagger resulting in his death.

The learned counsel for the petitioner has submitted that as far as the petitioner is concerned, he is alleged to have assaulted with lathi and if at all any of the accused persons have complicity in the matter, it is those who were armed with knife and dagger

Patna High Court CR. MISC. No.83483 of 2019(2) dt.16-12-2019 2/2 since the deceased had succumbed to his injuries on account of injuries sustained by him due to knife and dagger blow. It is further submitted that exactly similarly situated co-accused person, namely, Ram Ekbal Sing has been granted the privilege of bail by a coordinate Bench of this Court vide order dated 27.11.2019 passed in Criminal Misc. No. 60945 of 2019. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 17.08.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Vth, Kaimur at Bhabua in connection with Bhabua P.S.
