The petitioner seeks bail in connection with Bettiah Town P.S. Case No. 206 of 2018 registered under Sections 30-A, 35, 38, 56 of Bihar Prohibition and Excise Act2016. 339 lts. of foreign liquor is said to have been recovered from rented room of the petitioner and Renu Rani who happens to be wife of the petitioner and they were apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no
Patna High Court Cr.Misc. No.23157 of 2018(5) dt.21-06-2018 2/2 concern either the seized liquor or with any trade of liquor. He has been falsely implicated in this case at the instance of his enemy. He has no criminal antecedent. He has been languishing in custody since 22.03.2018. Similarly situated co-accused, namely, Renu Rani has been enlarged on by a co-ordinate Bench of this Court vide order dated 8.05.2018 passed in Cr. Misc. no. 22862 of 2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Bettiah, District-West Champaran in connection with Bettiah Town P.S.
