27-06-2018 Heard Sri Paras Nath, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail on behalf of the petitioner, who is in custody since 11-02-2016 in Barun P.S. Case No. 16 of 2016 registered for offence under Sections 394/411 of the Indian Penal Code.

Earlier, the prayer for bail of this petitioner was rejected on 19-08-2016, vide Cr. Misc. No. 32220 of 2016. Since no progress in the case has taken place, the petitioner filed the present petition renewing his prayer for bail. In this case, by order dated 18-04-2018, a report from the court below was called for regarding status of the trial, which has been received and kept at flag 'A'. From perusal of the report, it appears that the case was fixed for supply of police

Patna High Court Cr.Misc. No.23500 of 2018(3) dt.27-06-2018 2/2 paper and framing of charge, in the meanwhile, one of the coaccused (Chhotu Ram) jumped bail and for his appearance, N.B.W. has been issued. Meaning thereby that in near future, there is no possibility of commencement/conclusion of the trial. Accordingly, without any speedy trial, the petitioner may not be detained in custody for an indefinite period. Let the petitioner namely Sunil Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Aurangabad in connection with Trial No. 694 of 2016, arising out of Barun P.S. Case No. 16 of 2016.
