JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2019 The petitioners seek bail in anticipation of their arrest in connection with Jogbani P.S. Case No. 220 of 2019 dated 31.07.2019 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 354(b), 307, 379, 506 of the Indian Penal Code.

It appears that because of pending land dispute, an occurrence took place in which it has been alleged that all the accused persons participated and assaulted the members of the prosecution party.

Patna High Court CR. MISC. No.83478 of 2019(2) dt.17-12-2019 2/2 There is no injury report on record. Since the parties are agnates, a conscious decision has been taken by the prosecution side not to prosecute the petitioners any further.

Considering the background facts and the nature of accusation, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jogbani P.S. Case No. 220 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
