Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 22.11.2017 passed in Cr. Misc. No. 54158/2017 with a direction to the learned trial court to conclude the trial without a period of one year and liberty has been given to the petitioner to renew his prayer for bail. Submission of the learned counsel for the petitioner is that he is in custody for more than 15 months and up-till-now only one witness has been examined and the petitioner has no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be
Patna High Court Cr.Misc. No.23467 of 2018 (3) dt.02-05-2018 2/2 enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge III, Nalanda at Biharsharif in connection with Sessions Trial No.334 of 2017 arising out of Rahui P.S.Case no.256 of 2016, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
