2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 310 (4), 310 (5), 111 (2) (b) of the BNS and Section 25 (1-B) (a), 26 and 35 of the Arms Act.

3. The case of the prosecution is that the police received secret information that certain miscreants had gathered and were planning to commit some offence. Acting upon the said information, police raided the place, whereupon three persons were apprehended and arms were recovered from their possession.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that name of this petitioner has surfaced only in the statement of coaccused, namely, Sumit Kumar @ Rahul, who was apprehended

Patna High Court CR. MISC. No.86904 of 2025(2) dt.12-01-2026 2/2 by the police and has subsequently been granted bail by a coordinate Bench of this Court vide order dated 27.08.2025 passed in Cr. Misc. No. 59677 of 2025. It is further submitted that the case of this petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 19.06.2025

5. Learned APP appearing for the state has opposed the prayer of regular bail and submitting that the petitioner has seven criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dhanarua P.S. Case No. 494 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Masaurhi, Patna, subject to the conditions that the petitioner shall co-operate in the trial, shall remain physically present before the trial court on each and every date and that one of the bailors should be a family member of the petitioner.
