2. Learned counsel for the petitioner is permitted to make necessary correction in the first paragraph of the petition during the course of the day.
3. The petitioner seeks bail in connection with Sursand P.S. Case No. 531 of 2022 registered for the offence punishable under Sections 376, 504 and 506/34 of the Indian Penal Code and 4 of the POCSO Act.
4. The petitioner is accused of committing rape upon the victim.
5. From the reading of the FIR, it appears to be a case
Patna High Court CR. MISC. No.4447 of 2024(3) dt.21-03-2024 2/2 of consensual sex with the victim. The petitioner is in jail since 12.09.2023 having clean antecedent.
6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-6th-cum Special Judge (POCSO Act), Sitamarhi in connection with Sursand P.S.
