====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 29-01-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Panaura P.S. Case No.178 of 2023, registered for the offences punishable under Sections 366(A), 34 of the Indian Penal Code and under Sections 8/10 of POCSO Act.

3. As per the prosecution case, the minor daughter of the informant was kidnapped by the co-accused Rakesh Sada with the help of other co-accused persons including the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to village politics. He further submits that petitioner

Patna High Court CR. MISC. No.2182 of 2024(2) dt.29-01-2024 2/2 has no concern with the co-accused Dinanath Sada and there is no direct allegation against the petitioner. He also submits that petitioner has no criminal antecedent and he is in custody since 30.11.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge VI-cum-Special Judge (POCSO) Act, Sitamarhi in connection with Punaura P.S. Case No.178 of 2023.
