Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 329(4), 126(2), 115(2), 109, 324(4), 324(5), 74, 303(2), 352, 351(2), 351(3) and 3(5) of the Bharatiya Nyaya Sanhita. 3.
Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent the informant alleges that five accused persons including the petitioners came and assaulted him and also caused injuries to Syed Nishad Hussain, Sahida Jabin and Syed Amir Hussain by knife, blade, lathi, danda and pistol and also acted inappropriately with his

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from the side of the petitioners Kazimohammadpur PS case No. 270 of 2025 has been instituted against the informant and his side. It is further submitted that though it is alleged that the accused persons assaulted the injured by knife, blade, lathi, danda and pistol, but then from perusal of the injury report it would manifest that the injury has been caused on account of blunt trauma and the injury has been opined to be simple in nature except one injury of Sayad Nishad Hussain, whose injury has been opined to be grievous in nature, but then there is no specific allegation against accused persons of assaulting Sayad Nishad Hussain. It is further submitted that petitioners are not criminals. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners, but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that injury suffered by the injured has been opined to be simple in nature except one injury of Sayad Nishad Hussain and his injuries are not opined to be caused by sharp-edged weapon.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kazimohammadpur P.S. Case No. 264 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
