The petitioner seeks regular bail in connection with Choutham P.S.Case No.233 of 2019 registered for offences punishable under Sections 274, 275, 276, 419, 420, 467, 468 and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 as well as Section 27(b)II, 27((d), 28, 28(A) of the Drugs and Cosmetics Act.

Allegation against the petitioner is about recovery of 200 bottle of codeine wiscof syrup of 100 ml.from the vehicle of the petitioner.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, having no criminal antecedent and he is in custody for two months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 2nd cum Special Judge, Excise, Khagaria in connection with Choutham P.S.Case No.233 of 2019.

With the aforesaid observation, this application is allowed.
