The petitioner apprehends his arrest in connection with Jehanabad Malhila P.S. Case no. 20 of 2017, registered under Sections 341, 342 and 354/34 of the Indian Penal Code and Section 8 of the POCSO Act.
The accusation is that on 03.04.2017, in the evening, informant proceeded from her house to the shop of her father. In the way, petitioner with bad intention tried to caught her hand, but her baby started crying then petitioner moved at some distance, but again petitioner caught hold her both hands. Thereafter, she raised alarm and on hearing the alarm of the informant her mother along with Chappu Sao came there and made protest then petitioner fled away from there. Thereafter,
Patna High Court Cr.Misc. No.29000 of 2018(2) dt.09-05-2018 2/2 informant reached at the shop of her father and narrated the entire incidence.
Learned counsel for the petitioner submits that, in fact, vegetable shop of the petitioner is situated in front of vegetable shop of the informant and due to business rivalry some hot talks were exchanged, but with ulterior motive father of the informant got managed to implicate the petitioner in the present case. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Hehanabad Mahila P.S. Case No. 20 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
