The petitioner seeks bail in connection with Sohsarai P.S. Case No. 113 of 2023 instituted for the offence under Section 394 of the Indian Penal Code.

As per the prosecution case, two unknown persons on the point of knife snatched the ear-ring, mangalsutra and golden chain of the informant. It is further alleged that they also took Rs. 2500/- from her purse.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.06.2023. Petitioner bears five criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present

Patna High Court CR. MISC. No.6200 of 2024(2) dt.12-02-2024 2/2 case. The petitioner is not named in the F.I.R. rather the name of the petitioner has been surfaced in this case during the course of investigation on the basis of confessional statement of coaccused, namely, Kunal Kumar. No incriminating article has been recovered from the conscious possession of the petitioner. The charge-sheet has already been submitted in this case and no T.I.P. has been conducted as yet.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case and the period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sohsarai P.S. Case No. 113 of 2023.
