====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 21-10-2021 Heard Mr. Abhay Shankar Singh, the learned counsel for the petitioners and Mr. Murlidhar, the learned A.P.P. for the State.
The petitioners seek bail in anticipation of their arrest in connection with Vidyapatinagar P. S. Case No.34 of 2019, instituted for the offences under Sections 304B/ 34 of the Indian Penal Code.
The petitioners are father-in-law and mother-in-law of the deceased.
In this case, the case diary was called for on 11.12.2019 and the same has been received.
The learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.81141 of 2019(4) dt.21-10-2021 2/3 Chhotu Kumar @ Chhotu Singh @ Manjeet Kumar @ Manjeet and Prince Kumar, who are also an accused in the present case and are brother-in-law of the deceased, have been granted anticipatory bail vide order dated 04.12.2020 in Cr. Misc. No.28211 of 2020. Further that the husband of the deceased namely Sujit Kumar @ Banti had surrendered in the Court below and he has also been granted regular bail by order dated 17.02.2020 in Cr. Misc. No.66817 of 2019. The learned counsel for the petitioner further submitted that the deceased was being treated for her mental disorder for a very long time and she always displayed abnormal behaviour.
The learned A.P.P. for the State vehemently opposes the bail application.
Considering the facts in totality and that the brotherin-laws have been granted bail and the husband of the deceased has been granted regular bail and the present petitioners, being father-in-law and mother-in-law are directed to be released on anticipatory bail, in the event of their arrest or surrender before the learned Court below within a period of nine weeks on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 3rd Dalsingsarai, Samastipur in
Patna High Court CR. MISC. No.81141 of 2019(4) dt.21-10-2021 3/3 connection with Vidyapatinagar P. S. Case No.34 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
