2. The petitioner apprehends his arrest in connection with Biraul P.S Case No. 265 of 2025 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.
3. As per the prosecution case, total 122.400 litre of foreign liquor was recovered from the Jugar vehicle (make shift vehicle).
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that petitioner has got no criminal antecedent as

5. Learned counsel for the State opposes the prayer for bail of the petitioner.
6. From perusal of the F.I.R., impugned order and materials available on record it appears that petitioner is not named in F.I.R his name transpired during the course of investigation. No incriminating articles has been recovered from the conscious possession of the petitioner. Moreover, petitioner has got clean antecedent as stated in Paragraph No. 3 of the bail petition.
7. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge II, (Excise Act) Darbhanga in connection with Biraul P.S Case No. 265 of 2025 subject to the condition laid down under Section 482(2) of B.N.S.S, subject to the condition that petitioner shall remain present
