JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Sasaram Town P.S. Case No.1166 of 2014 registered under Sections 419 and 420 of the Indian Penal Code read with Section 10 of the Bihar Conduct of Examination Act, 1981, pending in the court of the Chief Judicial Magistrate, Rohtas at Sasaram. The accusation is that in the Examination of History- 4th Paper (Group-B) of B.A. Part-III, 2014 at the Examination Centre, in place of this petitioner, one Vikash was found sitting, who disclosed that he is sitting in the said examination in place of his brother (petitioner), who had gone to Gujarat to appear in the Examination. Patna High Court CR. MISC. No.82115 of 2019(3) dt.25-06-2020 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
