====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Excise P.S. Case No. 157 of 2019, corresponding to PR No. 41 dated 14.10.2019, registered for the offence punishable under Sections 30(a), 33 of the Bihar Prohibition and Excise Act, 2016. Allegation as per F.I.R. is that 210 litres of spirit was recovered from the Tempo in which the petitioner was travelling.

Submission of the learned counsel for the petitioner is that he is only passenger and has no concern with the alleged recovery. He is languishing in jail custody for more than four months having no criminal antecedent. Charge sheet has already been submitted in the instant case. There is no chance of tampering of evidences.

Having heard both the parties and considering the submissions made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge (Excise), Muzaffarpur in connection with Excise P.S. Case No. 157 of 2019 corresponding to PR No. 41 dated 14.10.2019.
