The petitioner apprehends his arrest in connection with Dumariyaghat P.S. Case No. 13 of 2019 registered for the offences punishable under Sections 188, 327 and 353 of the Indian Penal Code.

As per written report of the informant, who was Anchal Adhikari Kessaria, this case has been lodged against the petitioner. It is alleged that the petitioner again encroached the land of Gairmajarua Aam land bearing khata no.832 khesara no.5526, which was made free from encroachment earlier. Learned counsel for the petitioner submits that the occurrence took place on 05.12.2017 and F.I.R. has been lodged

Patna High Court CR. MISC. No.28 of 2020(3) dt.20-02-2020 2/2 on 24.01.2019. He further submits that the petitioner has no criminal antecedent. He further submits that he never put any structure on the land in question. The fact is that there is land dispute between the petitioner and Rajesh Kumar Yadav. He has himself enclosed the public road but on the basis of his influence took the local Revenue Karmchari in his collusion and got submitted totally false report.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Ist, East Champaran, Motihari in connection with Dumariyaghat P.S. Case No. 13 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
