Petitioner, already in custody, seeks bail in connection with Barauni (Chakia) PS Case No.326 of 2017, registered under Sections 307, 376, 511 and 34 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the story of attempt of rape is absurd as the allegation is levelled against the petitioner and other two accused, who are sons of the petitioner, as far as the allegation of causing firearm injury is concerned, that is not against the petitioner rather against his son Puran Nishad and the reason for false implication is that the informant and
Patna High Court Cr.Misc. No.30828 of 2018(2) dt.17-05-2018 2/2 other family members are accused in a case of murder of one of the sons of the petitioner and trial is going on and in order to put pressure this false case was instituted by a married lady of 35 years of age.
Having considered the aforesaid facts and circumstances, petitioner Govind Bind @ Govind Nishad is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Barauni (Chakia) PS Case No.326 of 2017.
