JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2020 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 307, 448, 302, 120(B) of the Indian Penal Code and Section 27 of Arms Act.

There is general and omnibus allegation against 10 FIR named accused person of firing, however, specific allegation is against co-accused-Bulu Rai and co-accused-Rishu Rai, Son of Sharangdhar Rai of causing firearm injury to three person out of whom one died and two were getting treatment at the time of lodging of the FIR.

No.81120 of 2019(3) dt.18-03-2020 2/2 Learned counsel for the petitioners submits that similarly situated co-accused-Sharangdhar Rai, Kamlesh Rai and Sri Prakash Rai @ Prakash Rai @ Prakash have already been allowed bail by different Coordinate Benches of this Court in Cr. Misc. No.1879 of 2020 and Cr.Misc.No.84912 of 2019. Learned counsel for the informant opposed the prayer for bail on the basis of aforesaid material as well as on the ground that the petitioners are threatening the witnesses. Considering grant of bail to others by this Court, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.

20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nagar (Buxar) Police Station Case No.747 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the trial of the case as well as petitioners shall not leave the country without permission of the learned Trial Court, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
