Petitioners apprehend their arrest in connection with Bakhri P.S.Case No. 324 of 2017 registered for the offences punishable under Sections 341, 323, 342, 506, 509, 376 of the Indian Penal Code and Section 4 of POCSO Act. Allegation against co-accused is of commission of rape and the allegation against the petitioners, who are ladies, is of assisting in commission of rape.
Submission of learned counsel for the petitioners is that petitioners are ladies and allegation of rape is against one Dharmendra Kumar and allegation against the petitioners is that they were assisting in commission of rape, which prima facie appears to be fake as ladies petitioners are sister and aunt of main accused.
Patna High Court Cr.Misc. No.44081 of 2018 (4) dt.05-09-2018 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail stating that in her statement under Section 164 Cr.P.C. she has named these petitioners and she is minor. Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Bakhri P.S.Case No. 324 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
