The petitioner seeks bail in Kotwali P.S. Case No. 74 of 2018 registered under Sections 417, 418, 419, 420, 120B, 467 and 466 of the Indian Penal Code and Sections 66(b), (c) and (d) of the Information Technology Act.
Biswajit Ram is said to have formed a Whatsapp group of several persons including the petitioner and said Biswajit Ram has sent answer sheet of the examination of I.T.I. to Mukesh Kumar and the petitioner Lallan Prasad which was informed to the informant by some unknown person by E-mail as well as by telephone.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.31227 of 2018 (3) dt.21-05-2018 2/2 that he has been falsely implicated in the case. He has no concern with the aforesaid occurrence. He happens to be friend of Biswajit Ram in his Whatsapp Group without knowing the criminal activity of Biswajit Ram. He has been languishing in custody since 17.02.2018. Similarly situated co-accused namely Nishant Kumar has been enlarged on bail by a co-ordinate bench of this court vide order dated 04.05.2018 passed in Cr. Misc. No. 25922 of 2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 74 of 2018.
