ANJANA MISHRA ORAL ORDER 11-12-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor on behalf of the State. The petitioners are in custody since 07.11.2019, in connection with Complaint Case No. C-2/681 of 2019 for the offences under Sections 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioners submits that the alleged recoveries were not made from the conscious possession of the petitioners but on account of the fact that the petitioner could not meet the illegal demand of the complainant, the alleged recoveries have been saddled on their shoulders. It is further submitted that the petitioners have no criminal antecedent.

No.81335 of 2019(2) dt.11-12-2019 2/2 Considering the aforementioned facts and circumstances and that the petitioners have no criminal antecedent, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II cum Special Judge, Excise Act, Sitamarhi, in connection with Complaint Case No. C-2/681 of 2019.
