This application for anticipatory bail arises out of Ghanshyampur P.S. Case No. 66 of 2015, disclosing the offence under Sections 406, 420 of the Indian Penal Code. On the basis of submissions, which have been made on behalf of the petitioner, it transpires that learned counsel is in possession of the entire case diary of the case, which is a confidential document. He has referred to various paragraphs of the case diary, which suggests that the petitioner is interfering in the course of investigation. He therefore, does not deserve the privilege of anticipatory bail.
This application is rejected for the said ground only. I have not gone into the merits of the allegation
Patna High Court CR. MISC. No.83516 of 2019(3) dt.30-06-2020 2/2 against this petitioner because his conduct in interfering in course of investigation by obtaining the entire case diary, in my opinion, disentitles him this privilege.
The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
Let the S.D.J.M., Biraul, Darbhanga submit a report as to the circumstance in which the petitioner could obtain the entire case diary.
