JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mojahidpur (Babbarganj) P.S. Case No. 121 of 2016 registered for the offences punishable under Section 7 of Essential Commodities Act.
Petitioner happens to be owner of pick-up-van which was said to be involved in the present occurrence. Admittedly, the aforesaid pick-up-van has already been released in favour of the petitioner vide order dated 13-092017 passed in Criminal Writ Jurisdiction Case No. 1473 of 2017 which is evident from perusal of annexure 3 to the petition. No.31684 of 2018 (3) dt.22-06-2018 2/2 petitioner does not lay any claim on the seized rice, accordingly, it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Mojahidpur( Babbarganj) P.S. Case No. 121 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) N.K/- U T
