The petitioner seeks regular bail in connection with Palanwa P.S. Case No. 151 of 2017, Tr. No. 282 of 2018 for the offences punishable under Section(s) 272, 273, of the Bihar Prohibition Excise Act, 2016.

The allegation is regarding the recovery of 81 liters of illicit liquor from the place situated at the back of the house of petitioner.

The learned counsel for the petitioner submits that the said place from where the recovery has been made does not belong to the petitioner and in fact no recovery has been made from the conscious possession of the petitioner. It is further submitted that the petitioner has a clean antecedent and is languishing in custody

Patna High Court Cr.Misc. No.31687 of 2018 (2) dt.31-05-2018 2/2 since 10.12.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-4th -cum-Special Judge, Excise, East Champaran, Motihari in connection with Palanwa P.S. Case No. 151 of 2017, Tr. No.282 of 2018.
