The petitioner, already in custody, seeks bail in connection with Taraiya P.S.Case No. 52 of 2018 registered under Section 420 of the Indian penal Code and 67 of the Information and Technology Act.
Allegation in brief is that informant's A.T.M. card was exchanged by some unknown persons and money was withdrawn from his saving account.
Submission is that at the relevant point of time, petitioner was guard in the said A.T.M. and merely on suspicion, without any basis, he has been implicated in this case and neither ATM card of the informant nor any other incriminating material was recovered from his possession, except his confessional statement given before the police.
Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.34512 of 2018(2) dt.28-06-2018 2/2 the petitioner, namely , Raj Kishore Yadav @ Faujdari is directed to be released on bail u2018pon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM 9th, Saran Chapra in connection with Taraiya P.S.
