The petitioner is languishing in custody since 31.05.2019 in a case registered for the offences punishable under Sections 399, 402, 414 and 413 of the IPC and Sections 25(1-B)a, 26 and 35 of the Arms Act.

The prosecution case is that on 30.05.2019 at about 4.30 P.M., on a secret information that miscreants are planning to commit dacoity, raid was laid and five accused persons including the petitioner were apprehended. From the possession of the petitioner, one country made pistol, two live cartridges, one motorcycle and one master key were recovered. It is submitted by learned counsel for the petitioner that the petitioner has been roped in the present case only on the basis of

Patna High Court CR. MISC. No.83999 of 2019(2) dt.18-12-2019 2/2 suspicion. Moreover, investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that recovery has been made from the possession of the petitioner.

Considering the fact that the investigation has already been concluded and the period under custody, coupled with the fact that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-2nd Saran at Chapra in connection with Amnour P.S. Case No. 146 of 2019.
