2. The petitioner seeks bail in connection with Noorsarai P.S. Case No. 199 of 2023 registered for the offences punishable under Section 392 of the IPC.

3. As per prosecution case, three unknown persons are said to have concertedly looted E-Rickshaw and mobile phone of the informant and fled away from the place of occurrence.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR. Petitioner was initially arrested in Noorsarai P.S. Case No. 208 of 2023 and later on remanded in all the other cases including the instant case. He further submits that petitioner is a khalasi working with different owner of Toto Rickshaw and a quarrel took place between

Patna High Court CR. MISC. No.7092 of 2024(4) dt.21-06-2024 2/3 petitioner and informant due to which the informant lodged the instant case against the petitioner. He further submits that petitioner is in custody since 08.06.2023 and bears criminal antecedent of four cases.

Learned APP for the State vehemently opposes the prayer for bail of the petitioner and submits that from perusal of impugned order it is evident that in TIP parade the informant has identified the petitioner and petitioner has got criminal antecedent of four cases which are more or less of similar nature. He further submits that bail prayer of co-accused Md. Israil has already been rejected by this Court vide Cr. Misc. No. 3671 of 2024 and the case of the present petitioner is identically same.

6. Considering the facts and circumstances of the case, nature of allegation levelled against the petitioner as well as the material available on record, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is hereby rejected.

7. However, the learned trial court is directed to conclude the trial within six months from the date of receipt/production of copy of this order to the court concerned. If the trial is not concluded within the stipulated period,
