The petitioner has filed the instant application for anticipatory bail apprehending his arrest in connection with Aurangabad (Town) P.S. Case no. 71 of 2019 registered for the offence under section 379 to which subsequently sections 420 and 411 of the Indian Penal Code were added. As per the allegation in the FIR, the Scorpio vehicle of the informant which was parked outside his house was stolen. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown and the vehicle was recovered from the co-accused Shyam Ranjan Paswan. Patna High Court CR. MISC. No.1551 of 2020(3) dt.26-02-2020 2/2 statement of co-accused Shyam Ranjan Paswan and Shravan Kumar. The said Shravan Kumar has been enlarged on regular bail by order dated 17.10.2019 passed in Cr. Misc. no. 62167 of 2019. The petitioner has no criminal antecedent. The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the above stated facts and circumstances, the Court is inclined to enlarge the petitioner on bail. The petitioner, above named, in the event of his arrest or surrender in the Court below within a period of six weeks from today in connection with Aurangabad (Town) P.S. Case no. 71 of 2019 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
