2. Petitioner apprehends arrest in a case registered for the offence punishable under section 457 and 380 of the I.P.C.

3. As per the prosecution case, some unknown accused persons has committed theft of ornaments, cash etc, from the house of informant after breaking Almira .

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner come to light during course of investigation. No incriminating articles has been recovered from the possession of the petitioner.

5. However, learned counsel for the State opposes the

Patna High Court CR. MISC. No.3289 of 2024(4) dt.29-04-2024 2/2 prayer for bail and submits that petitioner has got four criminal antecedent out of which three criminal antecedents are of similar nature.

6. Considering the nature of accusation and also the fact that petitioner has got three criminal antecedents of similar nature, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
