2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 85, 103(1) and 3(5) of B.N.S. and Sections 498A, 302 and 149 of the Indian Penal Code.
3. The case of the prosecution is that Raushani Devi (deceased) was married to one Nitish Chaudhary in the year 2014. It is alleged that after six months of marriage, the deceased was subjected to cruelty on account of non-fulfillment of dowry demand. The deceased has three daughter out of the wedlock. On 22.09.2025, the niece of the informant informed that her mother has been killed.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.88019 of 2025(2) dt.18-12-2025 2/2 petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the petitioner is mother-in-law of the deceased. The nature of allegation is general and omnibus. Main thrust of allegation is against the husband of the deceased. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, she is languishing in judicial custody since 22.09.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Atri (Atari) P.S. Case No. 390 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Gaya Jee.
