JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Petitioner apprehends his arrest in connection with Mirganj P.S. Case No. 275 of 2017 registered for the offences punishable under Sections 365, 363 and 34 of the Indian Penal Code.
Petitioner is not named in the FIR and later on his name transpires during the course of investigation in the confession of the co-accused.
Submission of learned counsel for the petitioner is that, as a matter of fact, petitioner's motorcycle was stolen and in connection with search of motorcycle, he called upon the informant and others for enquiry, in which one of the co-accused was also arrested by the police in connection with the other case and for that the petitioner has made accused in this case, which
Patna High Court Cr.Misc. No.32086 of 2018 (3) dt.27-06-2018 2/2 with appear from Annexure- 2 and Annexure-4. It has also been submitted that the petitioner has no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XVI, Gopalganj, in connection with Mirganj P.S. Case No. 275 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
