2. The petitioner is apprehending his arrest in connection with Chiksaura P.S. Case No. 94 of 2025 registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act.
3. As per the prosecution case, 60 packets (60 litres) of illicit country-made liquor has been recovered from the sac from the possession of co-accused person.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner. He next submits that the

No.89281 of 2025(2) dt.22-12-2025 2/3 alleged illicit liquor has been recovered from possession of co-accused person, namely, Ram Babu Jamadar and on the basis of his confessional statement, name of the present petitioner has been transpired in this case. He next submits that petitioner has two criminal antecedents as stated in para-3 of the bail petition.
5. However, learned APP for the State opposes the prayer for anticipatory bail of the petitioner.

On perusal of the First Information Report and impugned order dated 15.11.2025, it appears that nothing has been recovered from the possession of this petitioner and name of the petitioner has been transpired on the basis of confessional statement of another co-accused person, namely, Ram Babu Jamadar. So, considering the aforesaid facts and circumstances of the case and submission of learned counsel for the petitioner, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District &

Case No.94 of 2025 subject to the condition as laid down under Section 482 of BNSS with further condition that the petitioner shall remain physically present before the learned Trial Court on each and every date as fixed by the learned Trial Court till conclusion of trial.
