1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 352, 351(2), 117(2), 303(2), 109 and 3(5) of the B.N.S.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that this petitioner along with Rahul assaulted her husband by iron rod causing injury on head thereafter Amirak Rai assaulted by lathi causing injury on chest.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the

It is next submitted that no doubt, it is alleged that petitioner assaulted the husband of the informant along with Rahul by an iron rod causing injury on head, but then, the injuries have been opined to be simple in nature. It is also submitted that one injury has been opined to be grievous in nature which is on non-vital part of the body i.e. forearm of the injured. It is next submitted that from side of the petitioner, Ram Krishana Nagar P. S. Case No. 228 of 2025 has been instituted against the informant and his side. It is next submitted that even persons from the side of the petitioner also suffered injury as on account of altercation, the occurrence is alleged to have taken place in which both sides assaulted each other. It is also submitted that petitioner will not abscond rather will cooperate in the investigation to prove to his innocence.

Learned A.P.P. opposes the anticipatory bail application, but then, is not in a position to rebut the submission made by the learned counsel appearing on behalf of the petitioner after perusing the case diary that the five injuries suffered by the injured has been opined to be simple in nature and grievous injury is on non-vital part of the body i.e. forearm.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the

No.88297 of 2025(3) dt.18-03-2026 3/3 event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Ram Krishna Nagar P. S. Case No.491 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.

7. The application stands allowed.
