The petitioners have filed the instant application for grant of anticipatory bail apprehending their arrest in a case registered for the offence under sections 323, 406, 420 and 504 of the Indian Penal Code.

As per allegation in the complaint, it transpires that the complainant was taken to Karnataka and inspite of him having worked as promised, the payment was not made by the accused persons. It is stated that the dues of the complainant is approximately Rs. 56,000/-. Further, allegation of assault is made against the petitioners.

Patna High Court CR. MISC. No.81642 of 2019(2) dt.11-12-2019 2/2 It is submitted by learned counsel for the petitioners that from perusal of the complaint itself it would evident that the allegations are one of civil dispute relating to non-payment of salary for the work done by the complainant.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegations, the court is inclined to enlarge the petitioners on bail. The petitioners above named, in the event of their arrest or surrender in the court below within a period of six weeks from today in connection with Complaint Case No. 2262 of 2017 is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur subject to the conditions as laid down in section 438 (2) of Criminal Procedure Code.
