JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with K. Hat (Sahayak) P.S. Case No. 901 of 2017 for the offences under Sections 387, 341. 451/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 06.03.2018. The petitioner was not named in the FIR. His name surfaced in this case in the confessional statement of co-accused Suman Kumar Singh and Niraj Kumar Jha. There is no recovery from the petitioner and no witness has named this petitioner for commission of the crime.

Considering the fact that the petitioner was not named in the FIR, he has remained in custody for nearly 2 1⁄2
