The petitioners are apprehending their arrest in connection with Warisnagar P.S.Case No.233 of 2016, registered for offences punishable under Sections 364/34 of the I.P.C in which subsequently section 302/201 of the I.P.C added. Allegation against the petitioners and others is of committing murder of son-in-law of the informant. It has been submitted on behalf of the petitioners that petitioners have not been named in the F.I.R., they have been made accused in this case only on the basis of suspicion and except that there is nothing against the petitioners to connect them
Patna High Court Cr.Misc. No.33081 of 2018 (2) dt.06-06-2018 2/2 with the occurrence. Moreover, the police after investigation submitted final form against the petitioners, however, the Chief Judicial Magistrate differing with the opinion of the police took cognizance against the petitioners.
Considering the facts and circumstances of the case, let the petitioners above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur, in connection with Warisnagar P.S.Case No.233 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
