This application has been filed for the grant of regular bail to the petitioners in connection with Sirdalla P.S. case No. 114 of 2018 for the offences punishable under Section 30(a) of the Bihar Prohibition and Exise Act 2016.

Learned counsel for the petitioners submitted that the petitioners have no criminal antecedent. The allegation is that petitioner no. 1 was carrying total 40 litres of toddy, whereas petitioner no. 2 was carrying 80 litres of toddy. They are in custody since 14.04.2018.

Learned Additional Public Prosecutor for the state is

Patna High Court Cr.Misc. No.34332 of 2018 (2) dt.14-06-2018 2/2 present.

Considering that the petitioners have no criminal antecedent and they have remained in custody for over two months, I would direct to release on the above named petitioners on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge cum M.A.C.T., Nawada, in connection with Sirdalla P.S. case No. 114 of 2018.
