The petitioner apprehends his arrest in connection with Sheikhpura P.S. Case No. 440 of 2019 for the offence punishable under Sections 420 and 409 of the Indian Penal Code.

The allegation is regarding recovery of 69 counter receipts/ original documents i.e. caste certificate, residential certificates, income certificates etc. from the R.T.P.S. counter of the Circle Office at Sheikhpura and upon interrogation made, the petitioner could not clarify as to why such huge number of receipts were kept, hence the informant has raised a suspicion that the same might have been kept for the purposes

The learned counsel for the petitioner submits that the petitioner is innocent and on account of heavy rush of the recipients, the said receipts have been kept. It is further submitted that there is no allegation of having taken bribe or having committed any sort of fraud. The petitioner is stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner above named is directed to be released on anticipatory bail on furnishing bailbonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura P.S. Case No. 440 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
