JUSTICE RAJESH KUMAR VERMA ORAL ORDER 25-04-2025 Heard Mr. Sunil Prasad Singh, learned counsel for the petitioner, Mr. Sheo Kumar Prasad, learned counsel for the Informant and Mr. Bhanu Pratap Singh, learned A.P.P. for the State.

2. The present modification application has been filed for modifying the order dated 26.10.2024 passed in Cr. Misc. No. 39618 of 2024 by which the petitioner has given under taking that he shall execute the sale deed of 28 decimal of land in favour of the informant within a period of 8 weeks.

3. The present modification application has been filed for relaxation of the said condition or alternatively direct the

Patna High Court CR. MISC. No.389 of 2025(7) dt.25-04-2025 2/2 petitioner to get the land executed within such time as may be directed by this Court.

4. Learned counsel for the Informant submits that number of indulgence has been granted to the petitioner to execute the sale deed as mentioned in the order dated 26.10.2024 passed in Cr. Misc. No. 39618 of 2024 but despite that, he has not complied with the said condition. In the present modification application also, learned counsel for the petitioner has taken indulgence number of times to inform this Court about the execution of the sale deed by the petitioner in favour of the informant but despite this also, no sale deed has been executed by the petitioner till date.

5. In view of the aforesaid, no case is made for modifying the order dated 26.10.2024 passed in Cr. Misc. No. 39618 of 2024. Hence, the present modification application stands dismissed.
