This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by order dated 16.05.2018 in A.B.P. No.2734 of 2018 passed by the learned Additional District and Sessions Judge Vth-cumSpecial Judge, Patna in connection with Maner P.S.Case No. 464 of 2016 registered under Sections 341,323,307,504,506,34 of the Indian Penal Code as well as under Sections 3(i)(x) of the Scheduled Castes and Scheduled Tribes Act.
Allegation against the appellant is of commission of injury at the head of the informant.
Learned counsel for the appellant submits that
Patna High Court CR. APP (SJ) No.1916 of 2018 dt.03-08-2018 Doctor has found simple injury.
Learned counsel for the informant opposed the prayer for anticipatory bail.
Considering the fact that the appellant had knowledge that his act might cause death, I am not inclined to enlarge the appellant on anticipatory bail.
Hence, prayer for anticipatory bail is refused. Accordingly, this appeal stands dismissed.
