JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Chhabilapur P.S. Case No. 10 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that the alleged liquor was recovered from an open place. Learned counsel submits that the copy of the seizure list was neither served on the petitioner nor on the family members of the petitioner. Considering the fact that the petitioner has no criminal antecedent and the liquor was not recovered from the conscious possession of the petitioner and as alleged the copy of the seizure list was not served on the petitioner nor on his family

Patna High Court Cr.Misc. No.33684 of 2018 (2) dt.05-06-2018 2/2 members, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special Judge, Excise, Nalanda at Bihar Sharif in connection with Chhabilapur P.S. Case No. 10 of 2018.
