The petitioner seeks bail in Jalalpur P.S. Case No. 73 of 2018 registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code.

Allegation against the petitioner is of committing theft of a motorcycle.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that no incriminating article has been recovered from the possession of the petitioner. It has been further submitted that petitioner is of unsound mind and is under treatment of Career Institute of Medical Science & Hospital,

Patna High Court Cr.Misc. No.34377 of 2018(4) dt.14-08-2018 2/2 I.I.M. Road, Lucknow, for last three years. Medical report has been annexed as Annexure-2 to this writ application. Petitioner has got no criminal antecedent and is in custody since 27.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Jalalpur P.S. Case No. 73 of 2018.
