14-06-2018 Learned counsel for the petitioner submits that in paragraph - 1 of the petition, an error has occurred and he requests for making correction. Learned counsel for the petitioner is permitted to make correction in course of the day. Heard Sri Surendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent, which fact has been stated in paragraph - 3 of the petition, apprehending his arrest in Gaighat (Benibad OP) P.S. Case No. 86 of 2018 registered for offence under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.33552 of 2018(2) dt.14-06-2018 2/2 that save and except confessional statement of the co-accused, there is no other material to connect the petitioner in the present case. It has been argued that nothing was recovered from conscious possession of the petitioner, rather in the case, recovery of small quantity of Indian make foreign liquor was shown from co-accused Ram Narayan Rai and on whose confession, which was made before the police, the petitioner was made accused.
Considering the nature of accusation and clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Rahul Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Gaighat (Benibad OP) P.S. Case No. 86 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
