Petitioner, already in custody, seeks bail in connection with Sultanganj PS Case No.7 of 2018 registered under Sections 302 and 324/34 of the Indian Penal Code.

Allegation in brief is that the son of the informant was called by his friends in the morning but he did not return, next day his dead body was found near a temple and it is alleged that his friends including the petitioner have killed him. Learned counsel for the petitioner submits that only suspicion is raised against the petitioner and only evidence is that in the day hours the deceased was seen along with the petitioner, except that there is no other material against him and he has no criminal antecedent except one case lodged under

Patna High Court Cr.Misc. No.35150 of 2018(2) dt.19-06-2018 2/2 Sections 323 and 504 of the Indian Penal Code. Having considered the aforesaid facts and circumstances, petitioner Sukuru Mian @ Sukru Miya is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bhagalpur in connection with Sultanganj PS Case No.7 of 2018.
