JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Raghopur P.S. Case No. 119 of 2017 for the offences under Sections 414, 272, 273, of the Indian Penal Code, Sections 30(a), 32(2), 41(1) of the Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b) a /26 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to the F.I.R., he submits that there was specific allegation of carrying fire-arm was against one Prabhu Rai, who was arrested at the spot. Learned counsel further submits that the said Prabhu Rai has been granted bail vide order dated 03.05.2018 in Cr. Misc. No. 26589 of 2018.
