The petitioner seeks bail in anticipation of his arrest in connection with Bariyarpur P.S. Case No. 30 of 2016 dated 05.03.2016 instituted for the offences under Sections 147, 148, 341, 323, 379, 427, 447, 504, 506 and 308 of the Indian Penal Code.

The petitioner is alleged to have threatened the informant that he would damage the construction made by the informant after coming back from a marriage ceremony. When this was protested, the informant as well as her husband were assaulted. The other members of the family were also assaulted.

Learned counsel for the petitioner has submitted that there is a dispute between the neighbours

Patna High Court Cr.Misc. No.33788 of 2018(2) dt.04-07-2018 2/2 with respect to construction of a parapet over the veranda of the house of the informant.

The injuries suffered by the husband of the informant are not stated to be grievous. There is a counter version of the occurrence also. The son and daughter of the petitioner are also stated to have been injured in the scuffle which had taken place between the parties.

The petitioner is an assistant teacher in a government school.

Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Bariarpur P.S. Case No. 30 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
