The petitioner seeks bail in Alouli P.S.Case No.128 of 2017 / G.R.No.1254 of 2017 registered for the offence under Section 302 of I.P.C.

Allegation against the petitioner is of killing his wife by strangulating her.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case as the marriage of this petitioner was not solemnized with the daughter of the informant namely Mamta Kumari and also the informant has himself deposed in his statement that Mamta Kumari never visited her matrimonial house. There is no eye witness to the occurrence.

Patna High Court Cr.Misc. No.38060 of 2018 (4) dt.12-09-2018 2/2 He has got no criminal antecedent. He is in jail custody since 24.04.2018.

Learned A.P.P. opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria, in Alouli P.S.Case No.128/17 /G.R.No.1254/17.
