2. The petitioner seeks bail in connection with Baisi P.S. Case No. 141 of 2024 registered for the offence punishable under Sections 420, 376, 504 and 506/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have committed rape upon the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is in custody since 23.10.2024.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. From the records of the case, it appears to be a case of consensual sex and considering the same, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Purnea in connection with Baisi P.S. Case No. 141 of 2024, subject to the condition that the petitioner will co-operate in the trial.
