Petitioner, already in custody, seeks bail in connection with Daraunda PS Case No.225 of 2017 registered under Sections 399/402/413/414 of the Indian Penal Code as well as under Sections 25(1-B)(a)26/35 of the Arms Act. Allegation in brief is that during the vehicle checking, the petitioner was found in possession of a loaded country made pistol with one live cartridge and also one arm from possession of petitioner's associate.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent, the recovery is fabricated and the petitioner is in custody for more than six months. Having considered the aforesaid facts and

No.35633 of 2018(2) dt.21-06-2018 2/2 circumstances, petitioner Lalu Kumar Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Daraunda PS Case No.225 of 2017 with condition that the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
